Chapter 13

Chapter 13 Bankruptcy is a reorganization for people who have secured debt up to $1,149,525.00 and unsecured debt up to $383,175.00. Above those debt levels, you must file under Chapter 11. Attorney Paul Newton offers a free thirty-minute consultation to determine your options in getting relief from your debt problems while retaining the property you want to keep. In Chapter 13 you make payments to your Bankruptcy Trustee over a three- to five-year period (the “plan period”) based on the amount of “non-exempt” equity you have, and your disposable monthly income (your “plan payments”). The computations can be very complex, but we are very proficient in preparing them!

 

Chapter 11

Chapter 11 Bankruptcy is a reorganization for people who have secured debt over $1,149,525.00 and unsecured debt over $383,175.00. It is available to businesses, while Chapter 13 is not. In a Chapter 11, the Bankruptcy Administrator oversees all income and expenses through monthly reports you are required to file. You will be required to work with us throughout the plan duration. Most of the hearings are in Raleigh, and are before a Judge. We are associated with a Bankruptcy attorney whose office is in Raleigh, so we can reduce the fees needed for our travel time back and forth.

 

Foreclosure Defense

In many instances, the filing of a Special Proceeding at the state court level may be the initial step by a lender to have a hearing to determine if a public sale on a particular parcel of real estate will be ordered by the Clerk.  Many people do not realize that even after a Special Proceeding has been filed, they may be able to save their property from being sold; but, you must act without delay or you could forfeit valuable rights in your property and be forced to relocate.
