North Carolina probate law dictates how a decedent's estate, assets and properties are transferred and distributed to family members and loved ones. Probate is generally required of assets that are titled in an individual's name. The statutes and case law have been put in place to ensure that the distribution is done in an orderly way, fulfilling the wishes of the deceased.

 

An estate that is probated without a will or trust is usually distributed according to instructions in the law called intestate succession. The better choice, however, is having the estate probated according to instructions contained within a will. The will determines who can act as the executor of the estate and how the decedent's property and assets are shared and distributed among family members and loved ones – according to the wishes of the deceased and not the legislature.
